On 27 March 2017, HKIAC hosted Judge David Waksman's lecture on "What Price the Access to Justice?" Judge Waksman discussed his landmark decision in Essar v. Norscot where he decided that an arbitral tribunal has discretion to award costs of third party funding, including the uplift payable by the funded party in the event of success. Judge Waksman was later joined by Rory McAlpine (Partner of Skadden) and Kim Rooney (Chair of Hong Kong's Law Reform Commission's Third Party Funding for Arbitration Sub-committee) to discuss views and questions about the decision and the use of third party funding in arbitration.
