HKIAC PANEL OF ARBITRATORS FOR INTELLECTUAL PROPERTY DISPUTES
- An applicant who is not on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the HKIAC Panel of Arbitrators for Intellectual Property Disputes must submit the following:
- Application Form - Form;
- Latest CV detailing the applicant’s experience in IP and arbitration;
- At least two written references regarding the applicant’s experience in IP and arbitration;
- Copies of at least two sanitised arbitral awards concerning IP-related disputes drafted by the applicant within the last five years;
- Proposed terms of appointment including a proposed hourly rate; and
- Any other materials which the applicant wishes to submit to demonstrate his or her experience in IP and arbitration.
In exceptional circumstances, HKIAC may waive the third and fourth requirements for eminent arbitrators or practitioners with substantial IP experience.
- An applicant who is already on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the HKIAC Panel of Arbitrators for Intellectual Property Disputes must submit the following:
- Latest CV detailing the applicant’s experience in IP and arbitration; and
- Any other materials which the applicant wishes to submit to demonstrate his or her experience in IP and arbitration.
- Please note that all applications will be reviewed by the HKIAC Secretariat to ensure that they meet the selection criteria. If the application satisfies the criteria, it is then placed before the Appointments Committee for consideration.
- Appointments Committee meetings are held on a quarterly basis. HKIAC will inform all applicants as to the Appointments Committee’s decision on their application.
- HKIAC has full discretion and reserves the right to admit or reject applications for inclusion on the Panel. HKIAC may also invite persons fulfilling areas of particular requirements including, inter alia, nationality, place of residence, language ability and experience, to apply for the Panel.
- HKIAC’s decisions as to the applications are final.
- Membership of the Panel is for a period of three years, ending on 31 December of the third year.
- * Awards "drafted" by the applicant will also include those to which they have contributed as part of a three member arbitral tribunal.
THE HKIAC PANEL OF EMERGENCY ARBITRATORS
An applicant who is not on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the Panel of Emergency Arbitrators must submit the following to hkiac_arbitrators@hkiac.org.
- Application Form - Form;
- latest CV including the applicant’s experience as emergency arbitrator or arbitrator;
- at least two written references regarding the applicant’s experience as emergency arbitrator or arbitrator;
- copies of at least two sanitised emergency arbitrator decisions or arbitral awards* drafted by the applicant within the last five years;
- proposed hourly rate; and
- any other materials which the applicant wishes to submit to demonstrate his or her experience as emergency arbitrator or arbitrator.
In exceptional circumstances, HKIAC may waive the third and fourth requirements for eminent arbitrators or practitioners with substantial experience in arbitration.
- An applicant, who is already on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the Panel of Emergency Arbitrators, may email hkiac_arbitrators@hkiac.org for further information regarding the application process.
- All applications will be reviewed by the HKIAC Secretariat to ensure that they meet the application criteria. If the application satisfies the criteria, it will then be placed before the Appointments Committee for consideration.
- Appointments Committee meetings are held on a quarterly basis. HKIAC will inform all applicants of the Appointments Committee’s decisions on their applications.
- HKIAC has full discretion and reserves the right to admit or reject applications. HKIAC may also invite persons fulfilling areas of any particular requirement including, inter alia, nationality, place of residence, language ability and experience, to apply for the Panel of Emergency Arbitrators.
- HKIAC’s decision of an application for the Panel of Emergency Arbitrators is final.
- The panel membership is for a period of three years, ending on 31 December of the third year.
- * Arbitral awards “drafted” by the applicant also includes those to which they have contributed as part of a three member arbitral tribunal.
THE HKIAC PANEL OF ARBITRATORS FOR FINANCIAL SERVICES DISPUTES
An applicant who is not on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the FSD Panel must submit the following:
1. Application Form – Form;
2. Latest CV detailing the applicant’s experience in financial services disputes and arbitration;
3. At least two written references regarding the applicant’s experience in financial services disputes and arbitration;
4. Copies of at least two sanitised arbitral awards concerning financial services disputes drafted by the applicant within the last five years;*
5. Proposed terms of appointment including a proposed hourly rate; and
6. Any other materials which the applicant wishes to submit to demonstrate his or her experience in financial services disputes and arbitration.
In exceptional circumstances, HKIAC may waive the third and/or fourth requirements for eminent arbitrators or practitioners with substantial experience in financial services disputes.
An applicant who is already on HKIAC’s Panel or List of Arbitrators and wishes to be considered for inclusion on the FSD Panel must submit the following:
1. Latest CV detailing the applicant’s experience in financial services disputes and arbitration; and
2. Any other materials which the applicant wishes to submit to demonstrate his or her experience in financial services disputes and arbitration.
- Please note that an application will first be reviewed by the HKIAC Secretariat to ensure that all required materials have been submitted. Upon receipt of the required materials, the Secretariat will submit them to the Appointments Committee for consideration.
- Appointments Committee meetings are held on a quarterly basis. The Scretariat will notify all applicants of the Appointments Committee’s decisions, once made.
- HKIAC has full discretion and reserves the right to admit or reject applications for inclusion on the FSD Panel. HKIAC may also invite individuals with a particular background or qualification, including nationality, place of residence, language ability and area of expertise, to apply for the FSD Panel.
- HKIAC’s decision on an application is final.
- Membership of the FSD Panel is for a period of three years, ending on 31 December of the third year.
- * Awards "drafted" by an applicant include those to which he or she has contributed as part of a three-member arbitral tribunal.
